Elon Musk filed legal proceedings against OpenAI and its major supporter, Microsoft, with claims for damages soaring between $79B and $134B yesterday.
Musk, an initial investor in OpenAI, alleges that the organisation has strayed from its original non-profit mission, diminishing his early contributions to negligible value.
Musk’s Alleged Share of OpenAI’s Success
According to recent court filings, Musk employed Paul Wazzan, a financial expert unfamiliar to him, to evaluate the worth of Musk’s contributions. Wazzan quantified Musk’s input at ”50 to 75 percent” of OpenAI’s present value by examining Musk’s financial backing, proposed equity, and non-monetised commitments, such as his reputation.
Yet this claim startled OpenAI and Microsoft, who argue Wazzan’s calculations are speculative and structured to benefit Musk.
History of Controversy
The controversy centres around Musk’s departure from OpenAI in 2018 due to disagreements on assessing his contributions. Musk’s estimate relies on a hypothetical scenario where he would have controlled 51.2 percent in a proposed for-profit arm.
Wazzan’s estimation included Musk’s interest in xAI, which neither shares business ties with OpenAI nor has its financial claims independently verified, suggesting an effort to artificially augment Musk’s damages claim.
OpenAI and Microsoft have sought to discredit Wazzan’s analysis, which they argue lacks logistical grounding and fails to account for other contributors, including developers who spearheaded ChatGPT. They contend that a jury should not be influenced by Musk’s financial interests in a nonprofit entity, labelling the lawsuit as an attempt to slow OpenAI’s progress in favour of Musk’s own AI ventures.
Trial Set for April 2026
Musk’s case is set for trial in April, and both OpenAI and Microsoft anticipate rebutting his assertions. They argue that the financial demands diverge from those permissible in dealings with nonprofit organisations and misrepresent legally recoverable damages.
Neither Wazzan nor representatives from xAI have commented on the ongoing proceedings. As the trial approaches, the tech world will closely monitor developments, raising questions about the ownership and value of contributions within AI technology ventures.
