New ADGM employment regulations to take effect in April 2025

The new framework introduces significant changes aligned with evolving global workplace practices.

The Abu Dhabi Global Market (ADGM) Registration Authority (RA) has released the Employment Regulations 2024 (referred to as “New Employment Regulations”), set to replace the Employment Regulations 2019. The new framework introduces significant changes aligned with evolving global workplace practices and aims to provide greater legal clarity for both employers and employees regarding their respective rights and obligations.

The New Employment Regulations will come into effect on April 1, 2025, providing employers with a transition period to adjust their internal policies, employment contracts, and related compliance measures.

Key Provisions in the New Employment Regulations:

  1. Definition of “Employee” expanded:
  2. The definition of “employee” has been amended to allow employers to hire remote employees and facilitate flexible working arrangements.
  3. Clarification on employee entitlements:
  4. The regulations address ambiguities concerning entitlements for various categories of workers, including part-time employees.
  5. Work permit and visa procedures:
  6. The new regulations outline specific requirements for obtaining and cancelling employee work permits and visas, removing uncertainties in these processes.
  7. Anti-discrimination and victimisation:
  8. The obligations related to workplace discrimination and victimisation have been expanded, imposing clearer responsibilities on employers.

The repeal of the 2019 Employment Regulations means that all employment practices within ADGM must adhere to the 2024 framework once it becomes effective.

Employers operating within ADGM are advised to review the new regulations and implement necessary updates to their employment-related processes before the effective date.
